A handcuffed man was able to escape a police cruiser by climbing through a partition that separates the front and back seats and jumped into another cruiser leading police on a pursuit that ended in his surrender.
Nestor Enrique Foley, 23, of Briar Lane, was arrested at the Broadway Inn’s parking lot when he returned to Mountain Top after stealing a Rice Township police cruiser following an incident at his residence, according to court records.
Foley showed signs of intoxication and was taken to Wilkes-Barre General Hospital, police said.
According to the criminal complaint:
Police in Fairview Township responded to a 911 call by Foley at about 9:40 p.m. Tuesday. Foley claimed he was hiding in a bedroom after someone opened a door at his residence and smashed glass.
Officers arrived and did not see any broken windows. Officers began yelling Foley’s name and encountered a man standing outside a rear screened porch.
Officers yelled, “Police, Stop!,” resulting in Foley running away initiating a foot chase to a yard on Cherry Lane.
Foley was observed by an officer holding a weapon, the complaint says.
After several commands by officers to drop the weapon, Foley agreed and got down on the ground saying, “Why didn’t you shoot me? I called 911. I wanted suicide by cop,” the complaint says.
Foley was handcuffed and placed in the rear seat of a Wright Township police cruiser and returned to the residence.
Police the weapon was a pellet gun.
Other officers searched Foley’s residence while a Wright Township police officer stayed with Foley inside the cruiser.
Foley asked to speak to the officer who opened a sliding window in a partition that separates the front and rear seats.
Foley requested that officers inside his home let his dogs out, then he pushed his way through the sliding window head first with his handcuffed hands in front of him, the complaint says.
The Wright Township officer grabbed onto Foley who managed to escape out the front passenger side door and jumped into a Rice Township police cruiser driving away.
Police notified 911 of the vehicle theft.
Police were able to follow the stolen cruiser by GPS and the last point of contact was near Pine Run Road in Hanover Township where it became disabled.
State police located the stolen cruiser traveling northbound on Interstate 81 but lost sight of the cruiser in the area of the Bear Creek/Plains Township exit.
Police contacted Foley through the cruiser’s radio and in response, Foley indicated he was returning to Mountain Top where he was arrested in the tavern’s parking lot.
Foley is facing charges of theft, escape, false reports, fleeing or attempting to elude police and driving under the influence of alcohol.
