On July 18 of last year, the same agent — whose name has not been released — saw a man trying to steal his car from his bedroom window at around 5 a.m.
He fired one shot and hit one of the perps in the back.
Police later found Adrian Ricketts, 23, of Canarsie, being treated for a back wound in Brookdale Hospital along with the two pals who helped with steal the car.
The other suspects were identified as Lyster Hensford, 23, of Flatbush, and Shamarie Jackson, 28, of Crown Heights.
Charges were ultimately dropped against all the suspects.
The NYPD turned the investigation over to the Queens district attorney’s office, who announced in March that they decided that the agent would not charged criminally for the shooting.
The FBI held an investigation to determine whether the agent complied with the bureau’s policies on the use of deadly force.
They did not say whether the agent has faced disciplinary actions for the previous incident.
